These Terms and Conditions apply when you use doctorrileysmith.com, including its forms, chat assistant and content, and when you buy services or programs through it. They are an agreement between you and Dr. Riley Smith, LAc, DACM, doing business as Smith Wellness Group (“we,” “us” and “our”).
By using this website, you agree to these terms. If you do not agree, please do not use the website.
Our Privacy Policy and Medical Disclaimer are part of these terms.
How these terms work with your other agreements
Some of our services come with their own written agreements. Coaching programs are governed by the program agreement you sign at enrollment, which covers program fees, payment plans, refunds, the First-Session Guarantee, sessions and scheduling. Acupuncture and related clinical care, including dry needling, Chinese herbal medicine, cupping, gua sha, tui na (Chinese medical massage) and massage, is governed by the intake and consent forms you complete before your first visit, whether that care is provided at our clinic or through a virtual patient visit. Programs that combine acupuncture and coaching are governed by both.
If these terms and a written agreement you sign with us say different things, the signed agreement controls for that service. These terms cover everything else, including your use of this website and any purchase that does not come with its own agreement.
Using our website
You may use this website for your own personal, non-commercial purposes. When you fill out a form, book an appointment or make a purchase, please give accurate information. You must be at least 18 years old to buy services or programs through this website. Care for patients under 18 is arranged by a parent or legal guardian.
When using this website, please do not:
- Break any law or use the website for anything harmful or fraudulent
- Try to access parts of the website or our systems you are not permitted to use
- Copy, collect or scrape content or information from the website using automated tools
- Upload viruses or anything that could damage the website or other users
- Pretend to be someone else or submit information on another person’s behalf without permission
If you have access to a client portal or account, keep your login details private. You are responsible for activity under your account.
We may change, pause or remove any part of this website at any time, and we may limit or end access for anyone who misuses it. We work to keep the website available and accurate, but we cannot promise it will always be error-free or uninterrupted.
The chat assistant
The chat assistant on our website is an automated tool powered by artificial intelligence. It is not Dr. Riley or a member of our team, even when it speaks in his voice. It is there to answer general questions about our services, programs and website.
The chat assistant can make mistakes, and its answers may be incomplete or out of date. Nothing it says is medical advice, a diagnosis or a promise of results. For anything about your personal health, book a consultation. Please don’t share personal health information in the chat. Conversations are recorded and stored as described in our Privacy Policy.
If the chat assistant’s answer ever differs from these terms, a signed agreement or information from Dr. Riley directly, those sources are correct.
Purchases and payments
All prices are in US dollars and may change at any time. A price change does not affect a purchase you have already made. Payments made through this website are processed securely by our payment processor at checkout.
Coaching program fees, payment plans, refunds and the First-Session Guarantee are covered in your program agreement. Fees and payment for acupuncture and other clinical care are explained in your clinic intake paperwork.
For purchases that do not come with their own agreement, such as paid challenges, events or digital products, all sales are final and non-refundable, except where the law requires otherwise.
Any subscription you buy from us renews automatically until you cancel it. The price, billing schedule and how to cancel are shown before you sign up.
If you have a concern about a charge, please contact us at hello@doctorrileysmith.com and give us a chance to resolve it before disputing it with your bank or card company.
Supplements and herbal products
Chinese herbal medicine is prescribed as part of clinical care and is covered by your clinic intake and consent forms. Any supplement or herbal product we suggest is a recommendation, not a requirement, and the decision to use it is yours. Recommendations are based on the information you share with us, so please tell us and your doctor about all medications you take, any allergies or health conditions, and whether you are pregnant, trying to become pregnant or breastfeeding. It is your responsibility to check with your medical provider before starting or stopping any supplement, herbal product or medication. Supplements and herbal products do not replace any medication you have been prescribed.
We may recommend supplements and herbal products through our Fullscript online dispensary or another dispensary or herbal pharmacy we work with. When you order through one of these, we may receive a modest commission. Our recommendations are based on your needs, and you are always free to buy recommended products elsewhere. Orders, including payment, shipping and returns, are handled by the dispensary or pharmacy under its own terms.
Please follow the directions on each product and any instructions we give you. If you notice a reaction or anything unusual, stop taking the product and contact your doctor, or call 911 in an emergency. Product manufacturers are responsible for the quality and contents of their products. We are not responsible for reactions to products used differently than directed, or when relevant health information was not shared with us.
Free and promotional programs
From time to time we offer free or promotional programs, such as challenges, detox programs, live events, webinars and downloadable guides. These are educational, and joining one does not make you a patient or client, as explained in our Medical Disclaimer. We may change, pause or end any of these programs at any time. Access to recordings, materials or bonuses may be available for a limited time only, and promotional prices or offers may expire without notice.
Some programs include group spaces, such as live calls or online communities. Anything you share there may be seen by other participants, so please share only what you are comfortable making public, and never share other people’s personal information. Please treat everyone with respect. We may remove anyone whose behavior is disruptive, harmful or inappropriate.
Our content and intellectual property
Everything on this website and in our programs belongs to Dr. Riley Smith, LAc, DACM, doing business as Smith Wellness Group, unless we say otherwise. That includes text, blog posts, social media content, videos, podcast episodes, companion guides, graphics, program materials and our frameworks, such as the 5R Method® for Burnout Recovery and Burnout is Biological™. Burnout to Balance®, the 5R Method® and Burnout is Biological™ are our trademarks.
You may use our content for your own personal, non-commercial learning. You may share links to our website, podcast or social posts, and quote short passages with credit and a link back to us. You may not copy, sell, redistribute, teach or build products from our content or frameworks, record live sessions without permission, or use our content to train artificial intelligence tools, without our written permission.
If you send us feedback or ideas, we may use them to improve our services without any obligation to you.
When Dr. Riley appears as a guest on another podcast, channel, publication or event, or contributes content to another business, our content and frameworks remain our property, and his comments are educational as described in our Medical Disclaimer. His appearance is not an endorsement of the host’s products or services unless he says so directly.
Links to other websites
Our website and content may link to other websites, apps and services, such as Fullscript, lab companies, podcast platforms, social media and online stores. We do not control these sites and are not responsible for their content, products, privacy practices or availability. A link is not an endorsement unless we say so directly. When you leave our website, the other site’s own terms and privacy policy apply.
Some links on our website and in our content, including links to Amazon, are affiliate links. As an Amazon Associate, we earn from qualifying purchases. This means we may receive a small commission if you buy through these links, at no extra cost to you.
Limits on our liability
This website and its content are provided “as is.” We do our best to keep information accurate and current, but we make no promises that it is complete, error-free or suitable for your particular situation.
To the fullest extent the law allows, we are not responsible for indirect or consequential losses that come from using this website, its content, the chat assistant or linked websites, such as lost income, lost data or emotional distress. For any claim related to this website or a purchase made through it, our total responsibility is limited to the amount you paid us for that purchase in the 12 months before the claim.
Nothing in these terms limits any responsibility that cannot legally be limited.
You agree to be responsible for any claims, costs or damages that result from your misuse of this website or your violation of these terms.
Governing law and disputes
These terms are governed by the laws of the State of California.
If you have a concern or dispute, please contact us first at hello@doctorrileysmith.com so we can try to resolve it informally. Most concerns can be settled this way.
If a dispute cannot be resolved informally, it will be handled as your signed agreement with us requires. For example, coaching program disputes are resolved through binding arbitration in San Diego, California, as described in your program agreement. Any other dispute related to this website will be resolved in the state or federal courts located in San Diego County, California. Either party may bring a claim in small claims court if it qualifies.
Changes to these terms
We may update these terms from time to time. When we do, we will change the “Last updated” date at the top of this page. Changes apply from that date forward and do not change the terms of a purchase you already made or an agreement you already signed. By continuing to use the website after an update, you accept the new terms.
If any part of these terms is found to be unenforceable, the rest of the terms still apply.
