1. Nature of the Challenge

The this Challenge is an educational and wellness program designed to provide general information about cortisol, the stress response, lifestyle factors affecting hormonal balance, and practical daily practices that may support overall wellbeing. The Challenge is delivered via live or pre-recorded video sessions, a private online community group, daily email content, and supplementary educational materials.

The Challenge is intended for general wellness education only. It is NOT a substitute for professional medical care, diagnosis, or treatment.

2. Not Medical Advice — Important Disclaimer

DR. RILEY SMITH IS A LICENSED ACUPUNCTURIST AND DOCTOR OF ACUPUNCTURE AND CHINESE MEDICINE. THE CONTENT PROVIDED IN THIS CHALLENGE DOES NOT CONSTITUTE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT AND SHOULD NOT BE USED AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE FROM A QUALIFIED HEALTHCARE PROVIDER

Nothing in this Challenge or its associated materials:

Creates a patient-provider relationship between you and the Company or Dr. Smith;
Constitutes the practice of medicine, nursing, pharmacy, acupuncture, or any other licensed healthcare profession;
Constitutes functional medicine consultation, clinical assessment, or individualized treatment;
Should be interpreted as a recommendation to begin, modify, or discontinue any medication, supplement, or prescribed protocol.

Always consult a qualified, licensed healthcare professional before making changes to your diet, exercise, supplement regimen, or lifestyle — especially if you have a diagnosed medical condition, are pregnant or breastfeeding, take prescription medications, or are under active medical care.

3. Eligibility

The Challenge is open to adults who are 18 years of age or older. By registering, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding agreements.

The Challenge is intended for educational purposes for individuals in generally good health. If you have a serious or unstable medical condition, we strongly encourage you to consult your physician before participating.

4. Program Content & Delivery

The Challenge includes, but may not be limited to:

Daily video or audio lessons delivered via email and/or a private online platform;
A private online community group for peer support and Q&A;
Daily action guides, worksheets, or written materials;
Optional live group calls or office hours (schedule subject to change);
Access to bonus resources or educational materials as announced.

All session schedules, content formats, and delivery methods are subject to change at the Company’s reasonable discretion. We are not responsible for technical issues, internet outages, or platform availability outside of our control.

5. Purchases, Upsells & Refund Policy

5.1 Challenge Registration Fee

The this Challenge is offered at a one-time registration fee of the applicable registration fee. This fee is non-refundable once access to Challenge materials has been granted. Live program participation required along with completion of all homework to qualify.

5.2 Upsell & Add-On Offers

During and after the Challenge, we may present optional paid offers including but not limited to: related programs and upsell offers as announced at the time of purchase. These are separate transactions governed by their own terms and refund policies, presented at the time of purchase.

5.3 No Guarantee of Results

Any testimonials or results shared in connection with this Challenge reflect individual experiences and are not typical. Your results will vary based on your individual health status, compliance, lifestyle factors, and many variables outside our control. The Company makes no guarantee of any specific outcome from Challenge participation.

6. Intellectual Property

All Challenge content — including video recordings, written materials, worksheets, frameworks (including the 5R Burnout Recovery Method™), assessments, email content, and any other materials provided — is the exclusive intellectual property of Dr. Riley Smith, LLC and/or Dr. Riley Smith. All rights are reserved.

By registering, you are granted a limited, non-exclusive, non-transferable, personal license to access and use Challenge materials for your own individual, non-commercial educational purposes only. You may not:

Reproduce, copy, redistribute, or share Challenge content with others;
Upload materials to any public platform or share in any group or online community other than those designated by the Company;
Use Challenge content to create derivative works, courses, programs, or coaching content;
Sell, sublicense, or commercially exploit Challenge materials in any form.

Any unauthorized use of the Company’s intellectual property may result in immediate removal from the program and potential legal action.

7. Community Guidelines & Conduct

Participation in any Challenge community group is a privilege, not a right. All participants agree to:

Engage with respect, kindness, and professionalism toward all participants and Company staff;
Refrain from sharing medical diagnoses, prescriptions, or clinical advice with fellow participants;
Not promote, solicit, or advertise their own products, services, or programs within the community;
Not post content that is defamatory, harassing, discriminatory, sexually explicit, or otherwise harmful;
Not share personal information of other participants outside the group without their explicit written consent.

The Company reserves the right to remove any participant from the community group at any time, with or without notice, for conduct that violates these guidelines or that the Company deems inappropriate in its reasonable discretion.

8. Recordings & Your Likeness

Live sessions, calls, and office hours may be recorded for educational purposes and made available to registered participants. By participating in any live session, you consent to being recorded. If you prefer not to appear on camera or have your voice recorded, you may attend with your camera and microphone off.

The Company will not use your name, image, or testimonial in any marketing materials without your separate, explicit written consent.

9. Testimonials & Results Disclosure

From time to time, we may request testimonials from Challenge participants. Any submission of a testimonial to the Company constitutes your grant of a royalty-free, perpetual, worldwide license to use, reproduce, and display your testimonial in marketing materials, social media, and the Company website, provided your identifying information may be displayed or anonymized per your preference at the time of submission.

10. Limitation of Liability & Assumption of Risk

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND DR. RILEY SMITH SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR PARTICIPATION IN THE CHALLENGE, INCLUDING BUT NOT LIMITED TO:

Any health outcome, physical reaction, or adverse event resulting from implementing Challenge content;
Any reliance on educational content as a substitute for professional medical advice;
Loss of data, technical errors, or platform unavailability;
Actions or statements of other participants in the community.

YOUR TOTAL REMEDY, IF ANY, SHALL BE LIMITED TO A REFUND OF THE CHALLENGE REGISTRATION FEE ACTUALLY PAID, IN THE COMPANY’S SOLE DISCRETION.

By registering, you voluntarily assume all risks associated with participation in a wellness education program and release the Company and Dr. Riley Smith from any and all claims, demands, or causes of action arising from your participation.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Company, Dr. Riley Smith, and their respective affiliates, officers, employees, and agents from and against any claims, liabilities, damages, judgments, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any third-party rights; or (c) your participation in or use of the Challenge.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from or related to these Terms or the Challenge shall first be subject to good-faith informal negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in San Diego County, California, under the rules of JAMS.

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION WITH RESPECT TO ANY CLAIMS ARISING UNDER THESE TERMS.

13. Modifications to Terms

The Company reserves the right to update or modify these Terms at any time. Material changes will be communicated via email to registered participants. Continued participation following notice of changes constitutes your acceptance of the revised Terms.
